TYPES OF RESIDENCE PERMIT
There are different types of residence permit in Italy:
Adoption, Acts of particular social value, Asylum, Business, Expected citizenship, Elective residence, Employment, Especial Protection, Foster care, Family reasons, Family reasons (child 14-18 years old), Integration of the underage (in the cases referred to Article 31 of Legislative Decree 286/1998), Justice, Medical Care, Medical Care (in the cases referred to Article 19, paragraf 2, letter d bis) of Legislative Decree 286/1998), Natural disasters, Pregnancy, Religious grounds, Residence permit for reasons of social protection (in the cases referred to Article 18 of Legislative Decree 286/1998), Residence permit for the victims of domestic violence (in the cases referred to Article 18 bis of Legislative Decree 286/1998), Residence permit for the victims of labour explotation (in the cases referred to Article 22 paragraf 12 bis and following of Legislative Decree 286/1998), Scientific research, Self-employment, Seasonal employment, Special mission, Sport events participation, Stateless Status, Study, Subsidiary protection, Training, Underage, Unemployment.
WHERE YOU NEED TO APPLY FOR THE FIRST RESIDENCE PERMIT OR FOR THE RENEWAL OF THE EXISTING ONE?
The first request and renewal of residence permit must be submitted:
– At the Italian Post Office – if required for reasons of Adoption, Asylum (renewal), Elective residence, Employment (renewal), Expected citizenship, Family reasons (renewal), Family reasons (child 14-18 years old) (renewal), Foster care, Religious reasons, Scientific research, Seasonal employment (renewal), Self-employment (renewal), Special mission, Stateless status (renewal), Study, Subsidiary protection (renewal), Training, Unemployment;
– At the Immigration Office of the Police Headquarters – if required for reasons of Acts of particular social value, Asylum (first issue), Business, Integration of underage (in the cases referred to Article 31 of Legislative Decree 286/1998), Justice, Medical care, Medical Care (in the cases referred to Article 19, paragraf 2, letter d bis) of Legislative Decree 286/1998), Natural disasters, Pregnancy, Residence permit for reasons of social protection (in the cases referred to Article 18 of Legislative Decree 286/1998), Residence permit for the victims of domestic violence (in the cases referred to Article 18 bis of Legislative Decree 286/1998), Residence permit for the victims of labour explotation (in the cases referred to Article 22 paragraf 12 bis and following of Legislative Decree 286/1998), Sport events participation, Status stateless (first release), Subsidiary protection (first issue), Underage;
– At the Sportello Unico Immigrazione established in the Prefectures – if required for first time for reasons of Employment, Seasonal employment, Self-employment and Family reasons (admission for family reunification);
* The residence permit shall not be required for stay in Italy for up to three months for reasons of Business, Tourism and Study.
WHEN YOU NEED TO APPLY FOR THE FIRST RESIDENCE PERMIT OR FOR THE RENEWAL OF THE EXISTING ONE?
The first residence permit must be requested within 8 working days from the arrival day in Italy.
The renewal of the permit must be obtained from sixty days before the expiry to sixty days later.
THE CONVERSION OF A RESIDENCE PERMIT
The law provides the conversion of a residence permit for another reason.
The application for conversion of a residence permit must be submitted within the validity period of the residence permit.
The application for conversion of a residence permit must be submitted at the Sportello Unico Immigrazione.
The conversion of a residence permit is possible in the following cases:
– from residence permit for acts of particular social value to residence permit for employment or self employment;
– from residence permit for integration of underage (in the cases referred to Article 31 of Legislative Decree 286/1998) in family reasons;
– from residence permit for unemployment to residence permit for employment or self employment;
– from residence permit for pregnancy to residence permit for family reasons (when on the foreigner holding a residence permit can be applied the circumstances described in Article 29 of the D.Lgs 289/98 that discipline the right to family reunification);
– from residence permit for seasonal employment to residence permit for employment;
– from residence permit for employment to residence permit for self-employment;
– from residence permit for employment or self employment to residence permit for unemployment0;
– from residence permit for underage to residence permit for study or employment;
– from residence permit for family reasons (child 14-18 years old) to residence permit for study or employment or self employment (at the age of 18 years);
– from residence permit for family reasons to residence permit for employment or self employment;
– from residence permit for reasons of social protection (in the cases referred to the Article 18 of Legislative Decree 286/1998) to residence permit for study or employment;
– from residence permit for the victims of domestic violence (in the cases referred to the Article 18 bis of Legislative Decree 286/1998) to residence permit for study or employment;
– from residence permit for the victims of labour explotation (in the cases referred to Article 22 paragraf 12 bis and following of Legislative Decree 286/1998) to residence permit for study or employment;
– from residence permit for subsidiary protection to residence permit for employment or self employment;
– from residence permit for study (or training) to residence permit for employment or self-employment (as provided by law).
WHAT TO DO IN CASE OF REJECTION OF THE APPLICATION FOR THE RESIDENCE PERMIT?
The rejection of the residence permit may be appealed to the Administrative Court within 60 days from the day of the notification of the rejection act. In case of rejection of the residence permit for family reasons, the foreigner may appeal, without limit of time, to the Ordinary Court, Specialized Section on Immigration, International Protection and Free Movement of EU Citizens.
