WHAT IS THE RESIDENCE PERMET EU FOR LONG-TERM RESIDENTS?

The residence permit EU for long-term resident is a permanent residence permit, valid as a personal ID for 5 years (later the applicant may request renewal by producing new photographs);

WHO CAN APPLY FOR THE RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS?

The residence permit EU for long-term residents may be required by foreigners who are holding the following requirements:

1) legal residence in Italy for at least 5 years;

2) holding a valid residence permit;

3) availability of an income which annual amount is not less than the annual social income refers to any type of contract (open-ended contract/fixed term contract and even apprenticeships);

4) have passed a test of knowledge of Italian language.*

* This requirement is not request if the applicant for residence permit EU for long-term residents is the beneficiary of international protection (refugee status or subsidiary protection status.

WHO CAN NOT APPLY FOR RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS?

The residence permit EU for long-term residents, however, may not be required by:

– holders of a residence permit for study or training*;

– holders of a residence permit for humanitarian reasons (special cases), or who is under temporary protection*;

– holders of short-term visas;

– foreigners that are consider dangerous to public order or state security;

* However, previous periods of possession of these types of permit, except for short-term stays, may be useful in the calculation of length of stay (5 years).

WHERE YOU NEED TO APPLY FOR THE RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS?

The residence permit EU for long-term residents may be required:

in the Italian Post Offices (Sportello Amico) – through the presentation of a yellow postal kit.

RIGHTS OF HOLDERS OF RESIDENT PERMIT EU FOR LONG-TERM RESIDENTS

The residence permit EU for long-term residents permits:

-to enter in Italy and in the other countries of EU without an entry visa;

-to carry out any kind of job or self-employed in Italy, except those that the law expressly reserves to citizen or prohibits to foreigner;

– to use the services and benefits provided by the government (welfare benefits, social security, those relating to field of medical, educational and social assistance, those relating to access to goods and services available to the public, including the access to the procedure for obtaining public housing units);

to participate in local public life.

RELATIVES FOR WHICH CAN BE REQUEST THE RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS

The residence permit EU for long-term residents can be required for the following relatives:

spouse not legally separated and older than eighteen years;

minor children, including those from the spouse or born out of marriage*;

adult children when, for objective reasons, they can not provide for their essential needs of life because of their state of health which involve their total disability*;

dependent parents;

* Children adopted or held in trust or exposed to protection shall be treated as children.

 Requirements for the extension of a residence permit EU for long-term residents to the relatives:

suitable accommodation that is within the minimum parameters requested by the regional law for public housing or which correspond to the health standards certified by the competent ASL;

sufficient income (also derived from the combined income of family members living together).

* Dependent relatives should satisfy the requirement of length of stay (5 years).

WHEN THE RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS CAN BE REVOKED?

The residence permit EU for long-term residents can be revoked in the following cases:

if acquired fraudulently;

– when the foreigner becomes a danger to public order and state security;

– when the requirements request for the issue are being missed;

– in case of absence from the territory of the European Union for a period of 12 months consecutive;

– in the case of obtaining a residence permit EU for long-term residents from another EU Member State;

– in case of absence from the territory of the State for a period exceeding 6 years.

* The legal separation or divorce does not cause the revocation of a residence permit EU for long-term residents for the relatives.

WHAT TO DO IN CASE OF REJECTION OR REVOCATION OF A RESIDENCE PERMIT EU FOR LONG-TERM RESIDENTS?

The rejection or the revocation of a residence permit EU for long-term residents may be appealed to the Administrative Court within 60 days from notification of the rejection act.
